Usule söveriz: formlar, süreler, tebligatlar, ertelemeler, biçimsel şartlar... Hukukun sürtünmesidir bunlar. Her şey daha hızlı, daha pürüzsüz olsa keşke, deriz. Sürtünmesiz bir hukuk, kusursuz bir hukuk gibi gelir kulağa. Ama fizik başka bir şey biliyor.

Sürtünme olmasaydı yürüyemezdin. Ayağın yere basıp itemez, kalem elinde durmaz, düğüm çözülür, hiçbir şey durduğu yerde kalmazdı. Sürtünme yavaşlatır, evet; ama aynı zamanda tutunmayı sağlar. Sürtünmesiz bir dünya hızlı değil, yönetilemez olurdu — her şeyin kayıp gittiği bir buz pisti.

Usulün gizli işlevi
Hukukun sürtünmesi de öyle. O can sıkan süreler, biçimler, aşamalar boşuna değil: acele karara karşı bir fren, keyfîliğe karşı bir kayıt, güce karşı bir gecikme koyarlar. Davacıyı çıldırtan o yavaşlık, aynı zamanda davalıyı koruyan şeydir. Bir "dur, önce dinle" mekanizması. Usul, adaletin düşmanı değil; aceleyle verilmiş yanlış kararların önündeki tümsektir.
Fazlası da zarar
Ama fizikte de öyle: çok fazla sürtünme, hareketi büsbütün durdurur. Motor tutuşur, çark döner ama ilerlemez. Aşırı usul de adaleti felç eder — geciken adalet, adaletsizliktir. On yıl süren bir dava, en sonunda "haklısın" dese bile, bir ömrü çalmıştır. Yani sürtünme az olursa kayarsın, çok olursa kilitlenirsin.
Bütün sanat ayarında: tutunmaya yetecek kadar sürtünme, ama sistemi kilitlemeyecek kadar. Usulü küçümsemek de tehlikeli, ona tapmak da. Çünkü usul, adaletin üstünde yürüdüğü zemindir — onu tümüyle kaldırırsan, adalet hızlanmaz; sadece tutunacak bir yer bulamaz. Tıpkı atalet gibi: fazlası da azı da değil, dengesi işe yarar.
We curse procedure: forms, deadlines, notifications, adjournments, formal requirements... These are the friction of law. If only everything were faster, smoother, we say. A frictionless law sounds like a perfect law. But physics knows something else.
A frictionless world
Without friction you couldn't walk. Your foot couldn't press and push off the ground, the pen wouldn't stay in your hand, the knot would come undone, nothing would stay where it was put. Friction slows you down, yes; but it also gives you grip. A frictionless world wouldn't be fast but ungovernable — an ice rink where everything slides away.

The hidden function of procedure
Law's friction is like this. Those maddening deadlines, forms and stages are not for nothing: they put a brake against the hasty decision, a record against arbitrariness, a delay against power. The very slowness that drives the plaintiff mad is the thing that protects the defendant. A "stop, listen first" mechanism. Procedure is not the enemy of justice; it is the bump in the road before decisions made in haste.
Too much also harms
But so it is in physics too: too much friction stops motion altogether. The engine seizes, the wheel turns but doesn't advance. Excessive procedure paralyzes justice — justice delayed is justice denied. A case that drags ten years, even if it finally says "you were right," has stolen a lifetime. So with too little friction you slide, with too much you seize up.
The whole art is in the calibration: enough friction to hold, but not so much that the system locks. To scorn procedure is dangerous, and so is to worship it. Because procedure is the ground on which justice walks — remove it entirely and justice doesn't speed up; it simply finds nothing to grip. Just like inertia: not too much, not too little — it's the balance that works.
