Kimsenin çıkarmadığı yasaThe law no one enacted

Hiçbir meclis daha bir yasa yazmadan önce, insanların çoktan kuralları vardı: örf, âdet, teamül. Örf, kimsenin çıkarmadığı yasadır — bir imza, bir oylama, bir resmî metin yok; yalnızca yeterince uzun süre tekrarlanmış bir yapış biçimi. Ve bir gün, o alışkanlık "yapılması gereken"e dönüşür. Bu nasıl olur?

Alışkanlıktan yükümlülüğe

Hume'un fark ettiği ince geçiş burada. Bir şeyi yeterince yaparız; tekrar, bir beklenti yaratır ("hep böyle yapılır"); beklenti de sessizce bir yükümlülüke dönüşür ("öyleyse böyle yapılmalı"). Olan, fark ettirmeden olması gereken olur. Kimse "artık bu kuraldır" demez; kural, ayakların açtığı bir patika gibi, yürüne yürüne belirir.

Örf, kimsenin çıkarmadığı yasadır: yeterince tekrarlanan bir alışkanlık, önce beklentiye, sonra yükümlülüğe dönüşür. Yasa hep tepeden inmez; bazen ayaktan yükselir.

İki tür büyüme

Hukuk iki biçimde büyür. Biri bina gibi: tasarlanır, çizilir, yasalaştırılır — yukarıdan aşağı, iradeyle. Öteki patika gibi: kullanıla kullanıla oluşur — aşağıdan yukarı, birikimle. Ticari örf, yerel teamül, meslek âdetleri hâlâ canlıdır; hukuk yalnızca devletin buyruğu değil, toplumun tortusudur da. Bu yüzden en yeni kanun bile, çoğu zaman eski bir örfü yazıya geçirmekten ibarettir.

Her eski, iyi değildir

Ama bir tehlike var: her köklü alışkanlık yasa olmayı hak etmez. Adaletsizlik de "âdettendir" diyebilir; zulüm de kendine bir gelenek uydurabilir. "Hep böyle yapıldı" bir gerekçe değil, olsa olsa bir başlangıç noktasıdır. Örf, hukukun hammaddesidir; ama her hammadde gibi, adaletin süzgecinden geçmeden kullanılamaz.

Sanırım sağlıklı bir hukuk düzeni ikisine de ihtiyaç duyar: tasarlayan aklın disiplinine ve biriken hayatın bilgeliğine. Yalnız binadan ibaret bir hukuk soğuk ve yapaydır; yalnız patikadan ibaret olan ise başıboş. İyisi, ikisinin birbirini düzelttiği yerdedir — insanın koyduğu yasa ile hayatın kendiliğinden ördüğü yasa arasında.

Before any parliament had written a single law, people already had rules: custom, usage, practice. Custom is the law no one enacted — no signature, no vote, no official text; only a way of doing things repeated long enough. And one day, that habit turns into "what ought to be done." How does this happen?

From habit to obligation

Here is the subtle transition Hume noticed. We do something enough; repetition creates an expectation ("it's always done this way"); and the expectation quietly becomes an obligation ("so it must be done this way"). The is becomes, without our noticing, the ought. No one declares "this is now a rule"; the rule emerges, like a path worn by feet, simply by being walked.

Custom is the law no one enacted: a habit repeated enough becomes first an expectation, then an obligation. Law doesn't always descend from above; sometimes it rises from underfoot.

Two kinds of growth

Law grows in two ways. One is like a building: designed, drawn, legislated — top-down, by will. The other is like a path: formed by being used — bottom-up, by accumulation. Commercial custom, local usage, professional practice are still alive; law is not only the command of the state but also the sediment of society. Which is why even the newest statute is often just the writing-down of an old custom.

Not every old thing is good

But there is a danger: not every entrenched habit deserves to be law. Injustice too can say "it's customary"; cruelty too can invent itself a tradition. "It was always done this way" is not a justification but, at most, a starting point. Custom is law's raw material; but like any raw material, it cannot be used without passing through the filter of justice.

A healthy legal order, I think, needs both: the discipline of the designing mind and the wisdom of accumulated life. A law that is all building is cold and artificial; one that is all path is unruly. The best lies where the two correct each other — between the law we make and the law that life weaves on its own.
